These Terms of Use ("Terms") govern your use of Fulnex POS ("the Software"), a free point-of-sale application provided by Rudi van Buuren, operating as Fulnex, a sole proprietor in South Africa ("we", "us"). By installing or using the Software, you agree to these Terms. If you do not agree, do not install or use the Software. These Terms are separate from the main Fulnex Terms of Service, which only apply if you connect the Software to a Fulnex account.
We grant you a free, non-exclusive, non-transferable license to install and use the Software on your own devices, for your own business or personal use. You may not resell, sublicense, or redistribute the Software as your own product, or remove any branding or attribution.
Fulnex POS is provided free of charge, with no time limit and no obligation to create an account or pay for anything. Connecting the Software to a paid Fulnex account for online-store sync, cloud backup, and phone reporting is entirely optional and governed separately by the Fulnex Terms of Service and Privacy Policy for that portion of the service.
Sales, staff, products, and customer records you enter into the Software are stored locally on your own device, in a local database file. We do not receive, see, or store this data unless and until you actively choose to connect the Software to a Fulnex account. You are responsible for backing up your own device — the Software includes an automatic local backup feature, but you should also keep independent backups (e.g. cloud storage, external drive) given that local data can be lost through device failure, theft, or damage outside our control.
The Software is provided "AS IS", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Software will be error-free, uninterrupted, or compatible with every printer, cash drawer, or hardware configuration.
To the maximum extent permitted by South African law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Software, including but not limited to lost sales, lost data, or business interruption. Our total liability for any claim arising from the Software shall not exceed R500, reflecting that the Software is provided free of charge.

We may release updated versions of the Software from time to time, distributed via GitHub Releases and the Fulnex website. We are not obligated to provide updates, and features may be added, changed, or removed in future versions.
You may stop using the Software and uninstall it at any time. We reserve the right to discontinue distributing the Software at our discretion; existing installations will continue to function.
These Terms are governed by the laws of the Republic of South Africa. Disputes shall first be resolved by good-faith negotiation. If unresolved, disputes shall be referred to the High Court of South Africa, Western Cape Division.
We may update these Terms from time to time. The current version will always be available at this page and inside the Software itself.
